Personal Injury Attorneys in Austin TX

After a serious accident, you may feel like you’re short on allies.

What you do after an accident can determine how much money you can collect from insurance companies and the person responsible for your injury.  Texas law only allows you a short time to file a lawsuit to collect the money you need to pay for your injuries.  Some health insurance companies won’t pay your hospital bills if you’ve been injured in certain types of accidents.  Getting paid the maximum fair amount of money for your injuries requires careful evaluation of the facts of your case and knowledge of what the law allows you to recover.  Contact us for a free, no obligation case evaluation.

Personal Injury Attorney in Austin, TX

Accidents never come at a convenient time, and if you’re unfortunate enough to be injured in a car accident, you can expect your life to be substantially disrupted. You will be facing doctor visits, rehab, missed work, and mounting medical bills.

If you’re considering trying to negotiate with the insurance company on your own, you may not understand what a tremendous undertaking dealing with an insurance company can be. In addition, you’re going to need to concentrate on getting your medical appointments, recovering your health, and getting your life back together. You’re going to need help. A personal injury attorney can help you negotiate with your insurers while you focus on your recovery.

Elements of a Personal Injury Case

You may successfully present a personal injury claim when you can demonstrate that these four elements are present:

A Duty of Care Existed

Whoever injured you had a moral obligation to protect your safety and well-being. This happens, for example, when drivers act in ways that are safe and reasonable towards those around them.

The Duty of Care Has Been Breached

This means that the plaintiff must prove that the defendant failed to behave in a way that a reasonable person would have, in similar circumstances. Thus, negligence exists.

You must prove that it was the defendant’s actions that caused your injuries or accident.

You must prove that there were losses or damages, whether economic or non-economic or both. And the purpose of the lawsuit is to seek to recover them.

The Statute of Limitations for Texas Lawsuits

If you were injured in Texas due to an accident, a slip and fall, or any other event that resulted in an injury to you, you may find yourself considering filing a claim. This thought may not occur to you the precise day the injury took place. You may have waited until you had that necessary surgery or until you realized that you might not be able to go back to work for the foreseeable future. However, you should know that the statute of limitations does determine a time limit as to when you can file that claim. The statute of limitations states that you only have two years from the date when the accident or injury took place to file the claim. Going over that time limit means that your case will not be heard. In this case, the defendant will most likely file what is called a “motion to dismiss” and the court will summarily dismiss your case.

What losses or damages can you seek compensation for?

As a plaintiff, you may seek compensation for two basic categories of damages: economic and non-economic. Here’s what each one of them comprises:

Economic Damages

In short, economic damages are those that can easily be quantified monetarily. Items that can be considered as economic damages are:

Medical Expenses

Keep a tally of everything you have spent since the accident or injury took place. Were you transported to a health care facility by ambulance? Add it. Did you require medical treatment, medications, surgeries, rehabilitation? Add those as well. Most importantly, if you are under continuing treatment or if you will require rehabilitation or more medication in the future, add those amounts to the total.

Loss of Earnings

Do your injuries prevent you from going back to work? You may present an estimate of the amount of money that you will not be making because of your injuries. You may also need the testimony of an expert to testify about your earnings capacity taking into account your age, state of your health, your past earning capacity, your talents and expertise, and your life expectancy.

Household Services

Do you require someone to come to your house to keep it clean, cook, or perform any other household services? You may be able to get this item covered, providing you did not have a housekeeper before you were injured.

Other Economic Damages

Besides being compensated for the property damage that you suffered, you may also include as economic damages vocational rehabilitation should you require it to be able to work again, and other out-of-pocket costs.

Non-Economic Damages

Non-economic damages, often referred to as pain and suffering, are much more difficult to quantify, but that doesn’t make them any less real. They may include:

  • Damage to reputation
  • Loss of enjoyment of life and daily activities
  • Emotional anguish
  • Worsening of existing conditions

If you have been injured in an accident, you may feel pain every day, you may have difficulty performing tasks that you used to take for granted such as getting dressed every morning. How much of the non-economic damages you are seeking to recover will you get may depend on the jury’s appreciation of what the appropriate amount should be. It may be hard to truly assign a monetary value to any of the above items, which is where a personal attorney can be of great assistance.

Damage Caps in Personal Injury Cases in Texas

You and your personal injury attorney have done a very thorough job and put together an explicit list of your injuries and property damage and the amount of damages you are claiming. However, you should know that although years ago there were no caps for the amount of damages you would have been able to recover, over time, caps have been introduced, mostly to deter frivolous suits. Here are the caps for different types of damages:

For medical malpractice suits

The entire amount of economic damages is allowed. As far as non-economic damages, caps are in place at $250,000 against doctors and against a healthcare provider. Caps are also capped at $500,000 for all medical care providers involved in your injury.
